These terms govern your use of our website and the purchase of shipping containers and modifications. Please read them before placing an order.

Introduction & Acceptance

These Terms and Conditions ("Terms") govern your use of CargoVaultContainers.com and the purchase of shipping containers and related services from CargoVault Containers, LLC ("CargoVault," "we," "us," or "our"). By accessing our website, placing an order, requesting a quote, or otherwise using our services, you agree to be bound by these Terms.

These Terms, together with our Privacy Policy, Cookie Policy, Warranty Policy, Return & Refund Policy, Shipping Policy, and Sales Tax Policy, constitute the entire agreement between you and CargoVault. If you do not agree, please do not use our services.

Definitions

  • "Container" means a new, used, or refurbished intermodal shipping container or a modified container sold by CargoVault.
  • "Modification" means any custom fabrication, conversion, or alteration to a container performed by CargoVault.
  • "Order" means a request to purchase products submitted through our website or by quote.
  • "Quote" means a written price estimate provided by CargoVault, valid for the period stated on it.
  • "Delivery" means placement of a container at the address you specify.

Eligibility

You must be at least 18 years of age and legally able to enter into binding contracts to place an order. By ordering, you represent and warrant that the information you provide is accurate and complete and that you have the authority to receive delivery at the address provided.

Products, Availability & Pricing

All containers are sold subject to availability. Prices are listed in U.S. dollars and do not include delivery, taxes, or modifications unless expressly stated. We reserve the right to correct pricing or typographical errors and to modify prices without notice. Custom modification pricing is provided via quote and is valid for thirty (30) days unless otherwise stated.

Product images and descriptions are provided in good faith; used containers may show cosmetic variation that does not affect structural integrity or weather-tightness. Condition grades (new, refurbished, used wind-and-water-tight) are defined in our Warranty Policy.

Orders & Acceptance

Submitting an order constitutes an offer to purchase. An order is confirmed only upon our acceptance and successful payment processing. We reserve the right to refuse or cancel any order, in which case any payment received will be refunded in full. Estimated delivery timelines are approximate and depend on location, availability, and site conditions.

Payment Terms

We accept major credit cards (Visa, Mastercard, American Express, Discover) and bank wire transfers. At checkout, you may select Credit / Debit Card or Bank Wire Transfer. Card orders receive a secure payment link or invoice by email; bank wire instructions are provided on the order confirmation page. Apple Pay, Google Pay, and ACH icons displayed at checkout indicate the card networks and transfer types our payment processor supports. Orders are confirmed upon successful payment. Bulk and commercial orders may qualify for net-30 invoicing terms upon credit approval. Custom modification orders may require a deposit before fabrication begins; deposit terms are stated on your quote.

Available payment methods may be limited by administrative settings shown at checkout. We do not store full card numbers; payments are processed through PCI-DSS compliant, SSL-encrypted infrastructure.

Delivery & Risk of Loss

Delivery is made via tilt-bed truck to the address provided. Full delivery terms, timelines, site requirements, and freight calculation are set out in our Shipping Policy. The customer is responsible for ensuring site accessibility, including adequate clearance, firm ground, and required permits.

Title to a container passes to the buyer upon full payment. Risk of loss passes to the buyer upon delivery and placement at the designated site and signature on the delivery receipt. The buyer is responsible for securing the container immediately after delivery.

Container Condition & Inspection

New containers are one-trip units in near-pristine condition and are eligible for return within thirty (30) days of delivery. Used containers are wind-and-water-tight and cargo-worthy but may show cosmetic wear and are sold as-is. We guarantee every container meets the described condition grade. If a container does not meet its described condition, contact us with photographs for resolution under our Return & Refund Policy and Warranty Policy.

Modifications & Custom Work

Custom modifications are built to agreed specifications. Final designs are confirmed in writing before fabrication begins. Modification timelines are estimates and may vary based on material availability and project complexity. Any change orders after fabrication begins may affect price and timeline and must be agreed in writing.

Permits, Zoning & Compliance

The buyer is responsible for obtaining any required permits and for ensuring compliance with local zoning, building, and HOA regulations. CargoVault is not liable for permits, approvals, or compliance issues arising after delivery. We can provide general guidance and specification documents but do not obtain permits on your behalf.

Warranty

New containers carry the manufacturer's structural warranty. Used containers are sold as-is regarding cosmetics but are guaranteed wind-and-water-tight. Modified components carry a one-year workmanship warranty. Full warranty terms, exclusions, and claim procedures are in our Warranty Policy.

Returns & Refunds

Cancellation, return, and refund rights are governed by our Return & Refund Policy. New containers may be returned within thirty (30) days of delivery for any reason, defective or non-defective, subject to a 15% restocking fee and return shipping at the customer's expense. Used and refurbished containers are sold as-is and are non-returnable. Custom modification orders may be cancelled before fabrication begins; deposits may be non-refundable after fabrication starts.

Limitation of Liability

To the maximum extent permitted by law, our total liability arising out of or relating to a purchase is limited to the amount you paid us for the container. In no event are we liable for indirect, incidental, special, consequential, or punitive damages, including loss of profits, loss of use, or business interruption, whether based on contract, tort, or any other theory.

Indemnification

You agree to indemnify and hold harmless CargoVault and its officers, employees, and partners from any claim, damage, or expense (including reasonable attorneys' fees) arising out of your misuse of a container, your failure to obtain required permits, your violation of these Terms, or your violation of applicable law.

Dispute Resolution & Arbitration

Any dispute arising out of or relating to these Terms or a purchase will first be addressed through good-faith negotiation. If unresolved within thirty (30) days, the dispute will be resolved by binding arbitration administered in accordance with applicable rules, except that either party may seek injunctive relief in court to protect intellectual property or prevent irreparable harm. You and CargoVault each waive the right to participate in a class action or class-wide arbitration.

Governing Law & Jurisdiction

These Terms are governed by the laws of the State of Georgia and the United States, without regard to conflict-of-law principles. The courts located in Chatham County, Georgia, have exclusive jurisdiction over any matter not subject to arbitration, and you consent to that jurisdiction.

Intellectual Property

All content on CargoVaultContainers.com, including text, images, logos, graphics, and design, is the property of CargoVault Containers and is protected by U.S. and international intellectual-property laws. You may not reproduce, distribute, or create derivative works without our prior written permission.

User Conduct

You agree not to misuse our website, including attempting to disrupt service, introduce malware, scrape content, circumvent security, or use the site for any unlawful purpose. We may suspend or terminate access for conduct that violates these Terms or is harmful to us or other users.

Reviews & User Content

If you submit a review or other content, you grant us a non-exclusive, royalty-free license to display and use that content in connection with our business. You represent that your content is accurate, original, and not unlawful or infringing. We may moderate, edit, or remove content at our discretion.

Force Majeure

We are not liable for delays or failures to perform caused by events beyond our reasonable control, including weather, natural disasters, carrier availability, supply disruptions, government actions, pandemics, or other force majeure events. We will use reasonable efforts to resume performance as soon as practicable.

Changes to Terms

We may update these Terms at any time. The "Last updated" date will reflect the revision. Continued use of our website or services after changes are posted constitutes acceptance of the revised Terms. Material changes may be highlighted on the page.

Severability

If any provision of these Terms is found unenforceable, the remaining provisions will remain in full force and effect, and the unenforceable provision will be modified to the minimum extent necessary to make it enforceable.
